Agreement
By paying the deposit fee (as stipulated below), you are agreeing to our Terms and Conditions, as detailed below.

In the case of wet weather
– We strongly recommend that you have a suitable alternate venue in the case of wet weather. This must be a covered venue with enough space for us to perform as intended. It is your responsibility to make the call prior to the function about which venue to use if it is forecast to rain. 

– If you do not have an alternate venue, we cannot issue you a refund based on unfortunate weather.

– If you do not have an alternate venue, and it begins raining prior to our intended arrival time at the function, you can opt to reschedule the function to a later date (each situation will be assessed individually). 

– If you do not have an alternate venue, and it begins to rain, and you do not wish to reschedule, we will continue as planned as an Appearance* in the undercover/indoor areas of space available.

If you do not have an alternate venue, or have elected to go ahead in a non-covered space, and it begins raining during the function (to the point of not being able to continue), we will continue the function undercover/indoors as an Appearance* only. In light rain, we may still be able to continue as planned.

*Appearance (Wet Weather): 

This may not include any of the show elements, but may include physical activities, depending on space avaialable, due to WH&S requirements. 

– We do not ever wish to give you less than our best at any function, which is why we highly recommend that you plan an alternate space you can use in the possibility of rain, so that your experience is not dulled by unfortunate weather conditions.


Deposit and Securing Your Booking
– A deposit can be placed on an event up to 18 Months in advance.

– We require a 20% deposit for all private functions, or $150.00 (whichever is greater). This should be paid as soon as possible to secure your timeslot and avoid having your desired date & time taken by another booking.
– We cannot secure a booking slot without a deposit. We can tentatively hold a slot for a maximum of 3 days (or as per arrangement with us), after which time we will open up that time slot to other clients.
– This can be paid over the phone via credit card, or via direct deposit. For each payment, we will send you an invoice via email which will include our bank details.
– You will receive a payment receipt via email if you pay with credit card over the phone, and if you pay via direct deposit you will receive a final invoice after the total has been paid, to serve as your receipt.

– This deposit is NON-REFUNDABLE.

 

Paying Remainder of Cost

– The remainder is the sum of the total quoted cost minus the deposit fee.
– The remainder of the cost must be paid in full a minimum of one week prior to the event, and no more than 18 months prior to the event. This can be changed per individual arrangement with us.

– To avoid cancellation, pay close attention to these due dates. If payment has not been received by 3 working days prior to the event, and no arrangement or agreement has been made, we may cancel the event. This will also forfeit your deposit.

Cancellations & Refunds:
– Regarding wet weather circumstances, please refer to the wet weather section.
– If you decide to cancel your booking prior to the event taking place, you will not receive a refund of your deposit.
– If you cancel the booking during the event, you will not receive a refund of the deposit, and you may not receive a refund of the remainder of the cost.
– We will never cancel a booking unless there are extreme circumstances (i.e. performer is in a major car accident etc). In this circumstance, you will receive a full refund including the deposit and a special deal on another function (price at our discretion).
– If final payment has not been received by 3 working days prior to the event, and no arrangement or agreement has been made, we may cancel the booking. This will also forfeit your deposit.

 

Performer Safety
– If at any time a performer feels threatened, endangered, or is repeatedly harassed by somebody at the function, we reserve the right to leave at any time, with no refunds given.
– Our performers often engage in aspects of performance that may put their own well-beings at risk (i.e. appearing from rooftop, fight sequences, acrobatic shows, demonstrations, etc). Our performers accept all responsibility and liability for harm that is inflicted upon themselves due to entirely their own fault. However,

– If a performer is harmed during a performance whereby they are putting themselves at risk, caused by a guest wrongfully intervening, resulting in harm or severe harm to a performer and/or guest, we do not accept responsibility or liability for the harm to either party, and this is entirely the responsibility of the client only.


Photos/Videos
– Our performers may take videos and/or photos during any function. These may be used on our website, facebook and instagram pages, as well as in any other promotional media. If you would not like photos/videos to be taken by us, please inform us at any time throughout the booking process or during a function.

Accidents/Damages & Liability
– The Superhero Experience and its performers assume no responsibility or liability for accidents or damages to the host venue or its guests.
– The Superhero Experience and its performers are not responsible for allergic reactions or any other medical reaction stemming from the wearing of costumes, or any activity taken place before, during and/or after the party.
– Our performers often engage in aspects of performance that may put their own well-beings at risk (i.e. appearing from rooftop, fight sequences, acrobatic shows, demonstrations, etc). Our performers accept all responsibility and liability for harm that is inflicted upon themselves due to entirely their own fault. However,

– If a performer is harmed during a performance whereby they are putting themselves at risk, and a guest wrongfully intervenes, resulting in severe harm to a performer and/or guest, we do not accept responsibility or liability for harm to either party, and this is entirely responsibility of the client only.
– If any guest causes intentional damage to any props, costumes or any other supplies of The Superhero Experience, they will be billed accordingly for the damages. This cost is the responsibility of the client/host.

Dangerous Weather
– If the temperature nears, reaches or exceeds 38 degrees celsius at any event, or high UV radiation is anticipated, we reserve the right to reschedule/cancel any event. This is to protect our performers, as there is a high level of physical exertion involved, which can be dangerous in very hot weather. This will be considered on a case-by-case basis.
– If there are severe weather warnings in the area local to the event, we reserve the right to reschedule/cancel any event. This may include, but is not limited to, circumstances relating to storms, fire, heavy winds, rain, floods.
